1. Agreement to Terms

By accessing our website (cymbidiumlabs.com), downloading our mobile applications, or utilizing any services provided by Cymbidium Holdings LLC and Cymbidium Labs LLC ("Company", "we", "us", or "our"), you agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must discontinue using our services immediately.

2. Description of Services & Productivity Nature

Cymbidium Labs provides consumer software utilities, calendar tracking tools, and decentralized telemetry coordination services designed to assist users in monitoring publicly available appointment calendars. Our software is strictly an independent productivity assistant that facilitates user-directed local automation on your physical device.

3. 100% Free Public Utilities & Voluntary Community Tipping

Official government and consular appointments are sovereign public services provided completely free of charge. Cymbidium Labs provides consumer calendar monitoring tools (such as BaoDao Alert / 寶島鈴) as 100% free community utilities with zero upfront paywalls, no mandatory subscriptions, and zero commercial appointment brokering:

• 100% Free Core Functionality: All continuous calendar monitoring, real-time push notifications across consular offices, multi-preference target matching, offline QR passes, and automated rebooking tools are completely free for all users.
• Voluntary Consumable Tipping ("Tip Jar"): Users who successfully advance their appointments may optionally support server infrastructure and push delivery costs through one-time, voluntary consumable tips (e.g., Coffee, Taiwanese Bubble Tea, Bento Box). Tips are 100% voluntary, non-coercive, and do not gate or unlock any public appointment capacity or advantages.
• Zero Recurring Subscriptions: All tip transactions are non-renewing, one-time consumable purchases billed securely via Apple StoreKit or Google Play Billing. You will NEVER be enrolled in recurring subscriptions or auto-debit plans.
• Zero Financial Account Data Stored: All payments are processed directly by Apple or Google. We never receive, process, or store credit card numbers, bank accounts, or financial billing information.
• Refund Policies: Voluntary in-app tips are governed by standard store policies (Apple Media Services Terms / Google Play Terms of Service). Requests may be submitted directly through Apple (reportaproblem.apple.com) or Google Play order history.

4. Acceptable Use & Prohibited Conduct

You agree to utilize our software strictly for lawful, personal, and family purposes. You agree not to:

• Resell, scalp, broker, or commercialize consular appointment slots or reservations captured using our software.
• Attempt to hoard slots or monopolize public government appointment capacity.
• Reverse engineer, decompile, or attempt to extract the source code of our mobile binaries or coordination APIs.
• Inject fraudulent attestation tokens or manipulate client telemetry reports to distort scheduling algorithms.

5. Product-Specific Terms & Dedicated Policies

Individual software utilities distributed by Cymbidium Labs may maintain dedicated product terms, privacy disclosures, and operational parameters:

• BaoDao Alert (寶島鈴): Consular calendar monitoring and on-device appointment management features are additionally governed by the BaoDao Alert Terms of Service at baodaoalert.com/terms and Privacy Policy at baodaoalert.com/privacy. In the event of a direct conflict regarding consular scheduling operations, product-specific terms take precedence.

6. Intellectual Property Rights

All source code, user interface designs, logos, algorithms, and documentation developed by Cymbidium Labs LLC and Cymbidium Holdings LLC are the exclusive intellectual property of the Company and are protected by United States and international copyright, trademark, and patent laws.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CYMBIDIUM LABS LLC AND CYMBIDIUM HOLDINGS LLC DO NOT GUARANTEE THAT APPOINTMENT SLOTS WILL BECOME AVAILABLE, THAT LOCAL RESCHEDULING ATTEMPTS WILL SUCCEED AGAINST THIRD-PARTY CONSULAR SERVERS, OR THAT CONSULAR OFFICIALS WILL APPROVE ANY APPLICATION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CYMBIDIUM HOLDINGS LLC, CYMBIDIUM LABS LLC, THEIR MEMBERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OUR SOFTWARE OR MISSED TRAVEL DEADLINES.

9. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the internal laws of the State of Wyoming, without giving effect to any choice of law rules.
